Terms of Use

These Terms of Use (“Terms”) govern your access to and use of AtticLuxury.com and any related services (collectively, the “Site”) operated by Attic Luxury (“we,” “us,” or “our”). By accessing or using the Site in any way, you agree to be bound by these Terms. If you do not agree, do not use the Site.

We reserve the right to modify these Terms at any time. Changes become effective upon posting. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We will update the Effective Date above when changes are made.

You must be at least 18 years of age to use this Site or make a purchase. By using the Site, you represent and warrant that you meet this requirement and that you have the legal authority to enter into these Terms. If you are using the Site on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

The Site uses passwordless authentication. When you provide your email address, we send a magic login link or a one-time passcode. You are responsible for maintaining the security of your email account and for all activity that occurs through your Attic Luxury session.

You agree to:

• Provide accurate and current information when prompted
• Notify us immediately at attlux-questions@gmail.com if you suspect unauthorized access to your account
• Not share your login link or one-time passcode with any third party

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms.

4a. One-of-a-Kind Inventory

Every item listed on the Site is a unique, single-quantity piece (1-of-1). When you initiate checkout, the item is temporarily locked to your session for a period not to exceed 15 minutes. If payment is not completed within that window, the lock releases and the item becomes available to other buyers. We make no guarantee that an item will remain available for any period of time.

4b. All Sales Are Final

We offer a 10-day exchange window from the confirmed delivery date (as recorded by our shipping carrier's tracking system, not the estimated delivery date). Within that window, you may request an exchange for Archive Credit equal to the full purchase price of the item. See Section 5 for full exchange terms.

By completing a purchase, you acknowledge and agree that you have reviewed the item's condition grade, condition notes, photographs, and measurements, and that you accept the item in the described condition.

4c. Pricing

All prices are listed in U.S. dollars and are subject to change without notice until an order is completed. We reserve the right to correct pricing errors. If an item was listed at an incorrect price, we will notify you before fulfillment and offer you the option to purchase at the correct price or cancel the order for a full refund.

4d. Payment

Payments are processed by Stripe, Inc. By submitting payment, you agree to Stripe's Terms of Service. We do not store your payment card information. You authorize us to charge your selected payment method for the full order amount at the time of purchase.

If you have Archive Credits on your account, they will be applied automatically at checkout before any card charge is made.

We offer exchanges subject to the following conditions:

• You must request an exchange within 10 days of the confirmed delivery date as recorded by the shipping carrier. The exchange window does not open until delivery is confirmed in our system.
• Exchange requests must be submitted through your account portal at /account/orders.
• Once your request is approved, we will generate a prepaid return shipping label. Return shipping costs are the buyer's responsibility and will be charged to your payment method on file at Shippo's published rate.
• Archive Credit is issued to your account at the time the return package is scanned by the carrier, not upon our receipt of the item.
• Archive Credit has no cash value, is non-transferable, and may only be applied toward future purchases on the Site.
• Archive Credit does not expire, but it is forfeited if your account is terminated for violation of these Terms.
• Items returned in a condition materially different from their original shipped condition are not eligible for Archive Credit. We reserve the right to assess condition upon receipt and dispute ineligible returns.

You agree that you will not, directly or indirectly:

6a. Scraping and Automated Access

You may not, without our prior written consent:

• Use any bot, spider, crawler, scraper, script, browser extension, offline reader, or other automated means to access, index, collect, extract, or harvest any content, data, pricing, or information from the Site
• Use any automated means to interact with the Site, including to monitor availability of inventory, extract product details, or collect pricing data
• Reverse engineer, decompile, or attempt to extract source code or data structures from the Site
• Use the Site's content or data to build, train, or augment any competing product, dataset, or artificial intelligence model
• Systematically download or cache any portion of the Site's content
• Bypass, circumvent, or attempt to circumvent any rate limiting, access control, anti-bot, or technical measure we employ to protect the Site

Automated access places a disproportionate load on our infrastructure and misappropriates proprietary pricing and curation data. We actively monitor for automated traffic patterns and reserve the right to block IP addresses, user agents, or accounts engaged in any of the above activities without notice.

6b. Unauthorized Use

You may not:

• Use the Site for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any portion of the Site, its servers, or any systems connected to the Site
• Introduce any virus, trojan, worm, or other malicious code to the Site
• Interfere with or disrupt the integrity or performance of the Site or its data
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the Site to transmit unsolicited commercial communications
• Resell access to the Site or its content without our express written permission
• Use the Site to engage in fraudulent transactions or purchase items with a stolen payment method

6c. Competitive Intelligence

You may not access the Site for the purpose of building a competing service, benchmarking against a competing service, or monitoring our inventory, pricing strategy, or product catalog for competitive intelligence purposes without our prior written consent.

All content on the Site — including but not limited to text, product descriptions, photographs, graphics, logos, design elements, and the Site's overall look and feel — is the property of Attic Luxury or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your own personal, non-commercial shopping purposes. This license does not include:

• Any resale or commercial use of the Site or its content
• Any collection, use, or download of product listings, descriptions, or photographs for any purpose other than personal shopping
• Any use of data mining, scraping, or similar data gathering tools (see Section 6a)
• Any reproduction, duplication, copying, or derivative use of any Site content without our express written consent

Any unauthorized use terminates this license automatically.

If you submit any content to us — such as communications via email — you grant us a non-exclusive, royalty-free license to use that content for the purpose of responding to you and operating the Site. We will not publicly display personal communications without your consent.

You represent that any content you submit does not violate the rights of any third party and is not defamatory, obscene, or unlawful.

The Site contains links to third-party websites, including the FTC RN Number lookup database and shipping carrier tracking pages. These links are provided for your convenience. We have no control over third-party sites and are not responsible for their content, privacy practices, or terms. Accessing third-party sites is at your own risk.

Certain Site functions are powered by third-party services including Stripe (payments), Shippo (shipping), Postmark (email), Cloudinary (image delivery), and Supabase (database). Your use of these services through the Site is subject to their respective terms.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Site, including product descriptions, condition grades, or measurements, although we make reasonable efforts to ensure accuracy.

Pre-owned items are sold in the condition described and photographed. Natural fiber garments may have characteristics inherent to their age and prior use. Condition notes and photographs are provided to set accurate expectations; they are not a warranty.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Attic Luxury and its owners, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content you submit to us.

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the Site shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

Before initiating any formal legal proceeding, you agree to contact us at attlux-questions@gmail.com and provide a written description of the dispute. We will attempt to resolve the dispute informally within 30 days of receiving your notice.

If you believe that content on the Site infringes your copyright, please send a notice to attlux-questions@gmail.com that includes: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location on the Site; (c) your contact information; (d) a statement that you have a good faith belief the use is unauthorized; and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.

We reserve the right to suspend or terminate your access to the Site at any time, with or without cause and with or without notice. Reasons may include but are not limited to: violation of these Terms, fraudulent activity, chargebacks, or automated access to the Site.

Upon termination, your right to use the Site ceases immediately. Sections 6, 7, 10, 11, 12, and 13 survive termination.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Attic Luxury with respect to your use of the Site and supersede all prior agreements, understandings, and representations. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
